5. Billing, Payments, and Refunds

Payments for ProposalKit subscriptions are processed through Stripe and/or PayPal. By subscribing to a paid plan, you authorize us to charge your designated payment method on a recurring basis (monthly or annually, depending on your selected plan).

We do not store your full credit card number, bank account details, or PayPal credentials on our servers. All payment data is handled directly by the respective payment processor subject to their own terms of service and privacy policies.

Paid subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel at any time from your account dashboard or by contacting us.

We offer a 14-day money-back guarantee on the first payment of any new subscription. If you are not satisfied, contact us within 14 days of your initial purchase for a full refund. Refunds are not available for renewal payments, partial billing periods, or add-on purchases unless required by applicable law.

7.3 AI-Generated Content

Content generated using the AI features is provided for your use and may be edited, published, and distributed by you. You are solely responsible for reviewing and verifying any AI-generated content before sending it to clients.

8. Privacy and Data Handling

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8.1 Data Storage

ProposalKit stores proposal data, client information, and related content on your own WordPress server. We do not host or store your proposal data on our servers. You are responsible for the security, backup, and maintenance of your WordPress installation and database.

8.2 License Server Communication

The plugin communicates with our license server solely for the purpose of verifying your license status and delivering updates. This communication transmits your site URL, plugin version, and license key. No proposal data, client data, or personal content is transmitted during license verification.

9. Electronic Signatures Disclaimer

13.1 Termination by You

You may cancel your subscription and stop using the Service at any time. Cancellation takes effect at the end of your current billing cycle. You may continue to use paid features until your subscription period expires.

13.2 Termination by Us

We may suspend or terminate your access to the Service immediately and without notice if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We may also discontinue the Service entirely with 90 days' notice to active subscribers.

13.3 Effect of Termination

Upon termination, your license to use the plugin is revoked. Your proposal data remains on your WordPress server and is not affected by termination of your ProposalKit subscription. Features requiring an active license (e-signatures, payment collection, AI, and auto follow-ups) will cease to function.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Houston, Texas, under the rules of the American Arbitration Association. Each party shall bear its own costs of arbitration.

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction in Harris County, Texas.
